This page contains the general terms and conditions of Stretch. IP B.V., applicable to all training programmes, licences, services and materials we offer.
1. Applicability
These general terms and conditions apply to all training programmes, licences, services, materials and other activities of Stretch. IP B.V. Deviations are only valid when confirmed in writing by STRΞTCH.
2. Definitions
- STRΞTCH.: Stretch. IP B.V., established in the Netherlands.
- STRΞTCH.er: a professional who has successfully completed one or more STRΞTCH. training programmes and holds a valid licence.
- Licence: the right to commercially use the STRΞTCH. brand, method, protocols, materials and toolkit.
- STRΞTCH. Center: a fitness club or studio with certified STRΞTCH.ers and a valid STRΞTCH. licence.
- Trainee: any person taking part in a STRΞTCH. training programme.
- Training programme: a training programme offered by STRΞTCH., including theory, practice, examination and certification.
3. General: training programmes, certification & licences
STRΞTCH. develops professional assisted stretching programmes that can be applied by personal trainers and other movement professionals. For every programme, STRΞTCH. offers a training course.
3.1 Participation & background
STRΞTCH. advises trainees to have a relevant background in the human body (e.g. personal training, yoga, fitness instruction). STRΞTCH. reserves the right to refuse participation when this is not the case.
3.2 Certification
After successfully completing the training programme (theory, practice and examination), the trainee receives a digital and physical certificate. The certificate remains valid indefinitely. The certificate is always linked to an individual.
3.3 Licence
Upon obtaining a certificate, the trainee or fitness club automatically receives a licence for one year. If the trainee's course was paid for by the fitness club, the licence runs through the club. A licence entitles the holder to:
- Commercial use of the STRΞTCH. brand
- Listing on poweredbystretch.com
- Access to the STRΞTCH. toolkit (marketing templates, implementation tips, merchandise link, etc.)
- Use of the STRΞTCH. method and protocols
3.4 Licence renewal
- When a new training programme is completed within one year, the licence is automatically extended by one year, at no extra cost.
- Without a new training programme, the licence must be renewed annually at the applicable rate (see website).
- Renewal happens automatically, unless the STRΞTCH.er or STRΞTCH. Center cancels by e-mail. We send the advance notice 2 months before renewal and state how it can be cancelled. We indicate when the new period starts and that it can be cancelled monthly from that moment.
- If the licence is not renewed, the right to use the brand lapses and the listing on the website is removed.
3.5 Licence via fitness club
When a training programme is taken through a fitness club:
- The club is the licence holder
- Certificates remain linked to the individuals
- Upon leaving employment, the STRΞTCH.er can contact us about taking over the licence
- An official transfer request must be submitted by e-mail to STRΞTCH.
3.6 Exclusivity for STRΞTCH. Centers
A STRΞTCH. Center receives postcode exclusivity: within the same postcode area no second STRΞTCH. Center will be designated.
3.7 No employment relationship
A STRΞTCH.er does not work for STRΞTCH. The STRΞTCH.er builds their own service offering, independently or from within a fitness club.
4. Health & own risk
Trainees must report any physical or mental complaints prior to participation. In case of medical treatment, we advise consulting the treating physician beforehand.
Participation in training programmes and performing STRΞTCH. techniques is entirely at one's own responsibility and own risk.
5. Registration & payment
- Registration takes place via the website poweredbystretch.com.
- The trainee completes the registration form and accepts the terms and conditions.
- The registration is only final after full payment.
- Please contact us if you wish to pay in instalments.
- After payment, the trainee receives a confirmation by e-mail.
- Invoices are provided upon request.
6. Cancellation by STRΞTCH.
STRΞTCH. may cancel a training programme up to 1 day before the start, for example due to:
- Too few registrations
- Illness of the instructor
- Unforeseen circumstances
The trainee can then choose between:
- Transferring free of charge to another date, or
- A full refund of the amount paid
STRΞTCH. is not liable for additional costs such as travel or accommodation expenses.
7. Cancellation by trainee
7.1 Refund
- More than 1 month before the start: full refund minus € 25 administration costs
- 2 to 4 weeks before the start: 50% refund
- Less than 2 weeks before the start: no refund
7.2 Replacement trainee
The trainee may cancel free of charge when a replacement is provided who takes over the place and payment.
7.3 Statutory cooling-off period (right of withdrawal)
For online registration, a 14-day cooling-off period applies. Exception: when the training programme starts within these 14 days and the trainee agrees to this, the right of withdrawal lapses.
7.4 Force majeure & illness
Personal circumstances, illness or injuries are in principle at one's own risk.
8. Image and video material
During training programmes, photos and videos may be taken:
- For training purposes (community app)
- For marketing purposes
If the trainee does not give permission for marketing material, this must be indicated directly at the time of recording. By signing the agreement, the trainee declares to agree with internal use of image material.
9. Quality assurance (audit)
STRΞTCH. has the right to inspect STRΞTCH. Centers and STRΞTCH.ers (physically or digitally) for correct execution of the STRΞTCH. method, protocols and brand usage.
10. Intellectual property
All materials, protocols, videos, toolkit content, teaching materials and digital files are the property of STRΞTCH. It is prohibited to:
- Copy
- Distribute
- Resell
- Share with third parties
- Use commercially without a valid licence
Upon termination of the licence, all rights to use the STRΞTCH. brand and materials lapse.
11. Liability for injury
STRΞTCH. is not liable for any form of injury, damage or incidents arising during or as a result of:
- The performance of STRΞTCH. techniques by a STRΞTCH.er
- The use of the STRΞTCH. method within a STRΞTCH. Center
- Sessions, trainings or services offered by third parties
STRΞTCH.ers and STRΞTCH. Centers are fully responsible for the safe execution of the method and for correctly assessing the physical capacity of their clients.
STRΞTCH. offers training programmes, protocols and guidelines, but does not supervise the daily execution by STRΞTCH.ers or STRΞTCH. Centers.
12. Insurance
STRΞTCH.ers and STRΞTCH. Centers are themselves responsible for taking out appropriate insurance policies, including but not limited to:
- Professional liability insurance
- Business liability insurance
- Any additional insurance policies relevant to providing physical services
STRΞTCH. does not provide cover, insurance or liability for damage caused by STRΞTCH.ers or STRΞTCH. Centers to third parties.
13. No medical service
STRΞTCH. training programmes are not medical in nature. Although the method makes use of expert knowledge about the human body, the following applies:
- STRΞTCH.ers are not medical professionals (unless they are outside of STRΞTCH.)
- STRΞTCH.ers may not make medical diagnoses
- STRΞTCH.ers may not perform medical treatments
- STRΞTCH.ers may not give medical advice, not even based on complaints mentioned by clients
- STRΞTCH. techniques are not a substitute for physiotherapy, manual therapy, chiropractic or other medical care
14. Changes
STRΞTCH. may amend these terms and conditions. The most recent version is always available on poweredbystretch.com.
15. Applicable law
Dutch law applies to all services, agreements and training programmes of STRΞTCH.
